Protective measures: Enduring Powers of Attorney (EPA);

Legal Framework: Assisted Decision-Making (Capacity) Act 2015;

Competent authorities:

  • Decision Support Service (DSS) is responsible for overseeing decision support arrangements, registering agreements, and investigating complaints;
  • Courts (just for revocation of EPA or in case of disputes)

Access requirements:

  • EPA requires that the adult has decision-making capacity
  • It must meet formal requirements, including written documentation, signatures, and certifications by medical and legal professionals;

Procedure:

  • EPAs must be registered with the DSS, which reviews compliance with legal requirements.
  • Decision supporters (e.g., attorneys) must submit annual reports to the DSS.
  • Courts may intervene in cases of disputes, revocation, or concerns about abuse.
  • A court decision is required to revoke an EPA once it has been registered.
