The project’s first aim is to conduct a comprehensive analysis of 15 EU jurisdictions and identify out-of-court proceedings and competent authorities and professionals at national level. A final comparative report will give the overview of the extent and the modalities of the de-judicialisation process at a national level and detect critical issues and best practices.
The reports are based on a questionnaire and will be divided into three parts: family law, succession law, and status of natural persons. Rapporteurs will both analyse statutory provisions and case law of their respective country, assessing the current level of de-judicialisation of their State’s family and succession law. The reports will set the foundation for the final comparative report.
