Protective measures: Judicial measures (tutelle and curatelle); mandates for future protection;

Legal framework: French Civil Code (artt. 425, 426, 428-29, 440-442, 447).

Competent authority: Protection Courts;

Access requirementes:

  • Protection can be requested by the adult themselves, family members, cohabitants, the public prosecutor, doctors, or third parties (e.g., care home directors)
  • Requires a detailed medical certificate and supporting evidence
  • Judicial protection applies only when the person has not arranged for their own protection

Procedure:

  • Application: Filed by an eligible person with medical and supporting documents
  • Hearing: The judge hears both the applicant and the vulnerable person
  • Decision: A judgment is issued, possibly imposing an interim protection measure
  • Implementation: Protection takes effect, with the judge monitoring decisions
  • Review & Termination: Measures are valid for 5 years, renewable if necessary; they can be lifted upon medical reassessment
