Act: Lithuanian certificate of succession;
Legal framework: Civil Code of Lithuania (Article 1.75);
Competent authority: notary
Procedure:
- The succession certificate is issued three months after the succession event, provided there are no disputes and all heirs have been identified.
- The notary authenticates death, inheritance details, and examines property ownership and related records (such as public registers).
- The certificate cannot be revoked by the notary, even with the consent of all beneficiaries; only a court can invalidate it.
Nature and function: Lithuanian certificate of succession has a declarative nature. It does not create or change inheritance rights but serves as proof of them. In particular, it is needed for modifying ownership in public registers
